1. Agreement to Terms
These Terms of Service ("Terms") constitute a legally binding agreement between you and ENOLA Inc. ("ENOLA," "we," "our," or "us") governing your access to and use of the ENOLA website, mobile application, and related services (collectively, the "Service").
By accessing or using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, you may not access or use the Service. If you are using the Service on behalf of an organization, you represent and warrant that you have the authority to bind that organization to these Terms.
2. Description of Service
ENOLA provides a language learning platform that includes educational content, interactive exercises, personalized learning tools, pronunciation assessment, vocabulary building, and various features designed to help users learn languages more effectively.
We reserve the right to modify, suspend, or discontinue any aspect of the Service at any time, including the availability of any feature, database, or content. We may also impose limits on certain features and services or restrict your access to parts or all of the Service without notice or liability.
3. User Accounts
3.1 Registration and Account Security
To use certain features of the Service, you may be required to create an account. You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete.
You are responsible for safeguarding your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account or any other breach of security. We cannot and will not be liable for any loss or damage arising from your failure to comply with this section.
3.2 Age Requirements
You must be at least 13 years old to create an account and use the Service. If you are under 18, you represent that you have your parent or guardian's permission to use the Service and that they have read and agree to these Terms on your behalf.
4. Subscription Plans and Payments
4.1 Subscription Plans
ENOLA offers both free and paid subscription plans. By selecting a paid subscription, you agree to pay the subscription fees indicated for that service. We may change the fees and charges in effect, or add new fees and charges, by giving you notice in advance.
4.2 Payment Processing
We use third-party payment processors to bill you through a payment account linked to your account. Payment processing services may be subject to separate terms and conditions between you and the payment processor.
4.3 Automatic Renewal
Unless you cancel your subscription before the end of the current billing period, your subscription will automatically renew, and you authorize us to charge your payment method for the next billing period.
4.4 Cancellation and Refunds
You may cancel your subscription at any time through your account settings or by contacting us. Upon cancellation, you will continue to have access to the paid features until the end of your current billing period. We do not provide refunds for partial subscription periods unless required by law.
5. User Conduct
You agree not to engage in any of the following prohibited activities:
- Using the Service for any illegal purpose or in violation of any local, state, national, or international law
- Harassing, threatening, stalking, or abusing other users
- Posting or transmitting content that is obscene, pornographic, harassing, threatening, or abusive
- Impersonating another person or entity, or falsely stating or otherwise misrepresenting your affiliation with a person or entity
- Interfering with or disrupting the Service or servers or networks connected to the Service
- Attempting to gain unauthorized access to any portion of the Service or any other accounts, computer systems, or networks connected to the Service
- Using any automated means, including bots, scrapers, or similar technologies to access or use the Service
- Circumventing or modifying any security technology or software that is part of the Service
- Reverse engineering or decompiling any part of the Service
- Selling, transferring, or licensing your account or access to the Service to any third party
6. Intellectual Property Rights
6.1 ENOLA's Intellectual Property
The Service and its entire contents, features, and functionality (including but not limited to all information, software, text, displays, images, video, audio, and the design, selection, and arrangement thereof) are owned by ENOLA, its licensors, or other providers of such material and are protected by copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.
6.2 Limited License to Users
We grant you a limited, non-exclusive, non-transferable, and revocable license to access and use the Service solely for your personal, non-commercial use. You may not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any of the material on our Service, except as permitted by these Terms.
6.3 User Content
By submitting content to the Service (such as forum posts, reviews, or user-generated content), you grant ENOLA a worldwide, non-exclusive, royalty-free, perpetual, irrevocable, and fully sublicensable right to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, and display such content in any media. You represent and warrant that you own or control all rights in and to the content you post and that such content does not violate these Terms or any applicable law.
7. Disclaimer of Warranties
THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.
WE DO NOT WARRANT THAT THE SERVICE WILL FUNCTION UNINTERRUPTED, SECURE, OR AVAILABLE AT ANY PARTICULAR TIME OR LOCATION; THAT ANY DEFECTS OR ERRORS WILL BE CORRECTED; OR THAT THE SERVICE IS FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.
WE DO NOT WARRANT OR MAKE ANY REPRESENTATIONS REGARDING THE USE OR THE RESULTS OF THE USE OF THE SERVICE IN TERMS OF CORRECTNESS, ACCURACY, RELIABILITY, OR OTHERWISE.
8. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL ENOLA, ITS DIRECTORS, EMPLOYEES, PARTNERS, AGENTS, SUPPLIERS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:
- YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE SERVICE;
- ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE SERVICE;
- ANY CONTENT OBTAINED FROM THE SERVICE; AND
- UNAUTHORIZED ACCESS, USE, OR ALTERATION OF YOUR TRANSMISSIONS OR CONTENT
IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS EXCEED THE AMOUNT PAID BY YOU, IF ANY, FOR ACCESSING THE SERVICE DURING THE TWELVE (12) MONTHS PRIOR TO THE CLAIM.
9. Indemnification
You agree to defend, indemnify, and hold harmless ENOLA, its officers, directors, employees, and agents, from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to your violation of these Terms or your use of the Service.
10. Governing Law and Jurisdiction
These Terms shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law provisions. Any legal suit, action, or proceeding arising out of or related to these Terms or the Service shall be instituted exclusively in the federal courts of the United States or the courts of the State of California, in each case located in San Francisco County, and you consent to the personal jurisdiction of and venue in such courts.
11. Changes to Terms
We may modify these Terms from time to time. The most current version will always be posted on our website. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. By continuing to access or use the Service after the revisions become effective, you agree to be bound by the revised Terms.
